Terms and Conditions

1. Definitions

1. "Service" refers to the vehicle rental (self-drive) and chauffeur-driven (e-hailing) services offered by Taxspocab.
2. "Client", "You", or "Your" refers to any individual or entity that registers for and uses the Service.
3. "Driver" refers to an individual authorized and contracted by Taxspocab to provide chauffeur services.
4. "Vehicle" refers to any car, van, or other motor vehicle made available for booking through the Platform.
5. "Booking" refers to a confirmed reservation for a Service made via the Platform.

2. Eligibility & User Account

1. To be eligible for our Self-Drive Service, you must be between 21 and 65 years of age and possess a valid Malaysian Competent Driving License (CDL) or a valid International Driving Permit. Your license must have been active for a minimum of one year.
2. You are required to provide accurate, complete, and current information during registration, including your full name as per your identification documents (e.g., MyKad/Passport), a valid contact number, and email address.
3. You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You must notify Taxspocab immediately of any unauthorized use.

3. Bookings, Payments & Deposits

1. All bookings are subject to vehicle availability and are only considered confirmed upon successful payment and issuance of a booking confirmation from Taxspocab.
2. Full payment for the estimated rental charges, inclusive of any applicable Sales & Service Tax (SST), must be made at the time of booking through our designated payment gateways. All prices are quoted and charged in Malaysian Ringgit (MYR).
3. A refundable security deposit is required for all self-drive rentals. The deposit amount will be specified during the booking process. This deposit will be refunded to you within 7 to 14 working days after the vehicle is returned, subject to deductions for damages, traffic fines, missing fuel, or other outstanding charges.
4. Promotional codes must be applied at the time of booking and cannot be applied retrospectively. They are subject to their own specific terms and conditions.

4. Client's Responsibilities

1. Vehicle Inspection: You are required to inspect the vehicle's condition before starting your trip and upon its conclusion. This includes uploading clear photographs of the vehicle's exterior (front, back, left, and right sides) via the Platform when prompted. These photographs are crucial evidence in the event of any dispute over damages.
2. Proper Vehicle Care: You agree to maintain the vehicle in a clean and roadworthy condition. Smoking, vaping, and the consumption of durians or other strong-smelling foods are strictly prohibited inside the vehicle. A cleaning fee will be imposed for any violation.
3. Fuel Policy (Self-Drive): The vehicle must be returned with the same fuel level as recorded at the start of the rental. If the fuel level is lower, a refueling charge will be applied, which includes the cost of fuel plus an administrative fee.
4. Timely Return: The vehicle must be returned at the agreed-upon date, time, and location. Late returns will incur additional charges at the prevailing hourly or daily rate. Please notify us in advance if you anticipate a delay.

5. Prohibited Uses of the Vehicle

The vehicle shall not be used under any circumstances for the following purposes:

• Engaging in any illegal activities, including but not limited to transporting illegal substances, contraband, or engaging in criminal acts.
• Participating in racing, speed testing, rallies, or any form of competitive driving.
• Driving on unpaved roads, off-road trails, or in flood-prone areas.
• Towing other vehicles or carrying loads exceeding the vehicle's capacity.
• To be driven by any person other than the registered Client or a named additional driver officially approved by Taxspocab.
• To travel outside of Malaysia without obtaining prior written consent from TEXSPO TECHNOLOGY SDN. BHD..

6. Accidents, Damages & Insurance

1. In the event of an accident or any damage to the vehicle, you must immediately notify Taxspocab and file a Malaysian police report within 24 hours. Failure to do so may void the insurance coverage.
2. All our vehicles are covered by standard motor vehicle insurance. However, if damage or loss to the vehicle is caused by your fault or negligence, you are liable to pay a non-refundable insurance excess fee. The amount will be communicated to you and may be deducted from your security deposit.
3. You will be held fully liable for all repair costs, losses, and administrative charges if the vehicle is damaged while being used for any of the prohibited activities listed in Section 5, or if the damage results from a breach of these Terms.

7. Cancellation & Refund Policy

1. Cancellation by Client:
   • Cancellation made more than 48 hours before the scheduled pick-up time: Full refund of the rental amount.
   • Cancellation made between 24 to 48 hours before pick-up: 50% refund of the rental amount.
   • Cancellation made less than 24 hours before pick-up or in the case of a no-show: No refund will be provided.
2. The security deposit will be fully refunded for any valid cancellation. Please note that any processing fees charged by payment gateways are non-refundable.

8. Data Protection & Privacy

We are committed to protecting your privacy. Your personal data will be collected, used, and processed in accordance with our Privacy Policy and the Malaysian Personal Data Protection Act 2010 (PDPA). By using our Service, you consent to such processing.

9. Limitation of Liability

TEXSPO TECHNOLOGY SDN. BHD. shall not be liable for any loss or damage to personal belongings left in the vehicle. Furthermore, our liability for any direct losses arising from our failure to provide the Service as agreed is limited to the total rental amount paid for the specific booking in question. We are not liable for any indirect, incidental, or consequential damages.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

11. Amendments to Terms

TEXSPO TECHNOLOGY SDN. BHD. reserves the right to modify or amend these Terms at any time. The updated Terms will be posted on our Platform, and your continued use of the Service after such changes constitutes your acceptance of the new Terms.
